Waiver: Right of Rescission

We, the undersigned, have purchased HVAC products from Brandywine Valley Heating & Air Conditioning and we have asked Brandywine Valley Heating & Air Conditioning through its installed sales program, to install said HVAC products at our property located at Brandywine Valley Heating & Air Conditioning has advised us that we have the right to terminate the Proposal and Agreement for HVAC Installation within three (3) days from the date the Agreement is signed for any reason.

We nevertheless have decided that we wish to go forward with installation of the HVAC products and hereby waive the three (3) day right of termination for any reason. We understand that, notwithstanding anything to the contained in the Proposal and Agreement for HVAC Installation or any other Brandywine Valley Heating & Air Conditioning document or contract, the HVAC products are being purchased by us for Installation and that we assume all risk with respect to said termination rights and we release Brandywine Valley Heating & Air Conditioning and its employees, officers, affiliated entities, agents installers and contractors from any liability whatsoever in connection therewith

Terms and Conditions

Payment is due upon receipt. For those customers who have an open account established with Brandywine Valley Heating & Air Conditioning, terms are NET 30 Days. A monthly service charge of 1.5% or the maximum amount allowed by law, shall be assessed on all accounts that become past due. No services shall be rendered for any customers with a past due account. You agree to pay all reasonable collection costs.
Drain lines will be cleaned, flushed and tested at the time of the PMA or drain repair visit on equipment covered under this agreement. Brandywine Valley will not be liable for water leaks or damages which may occur due to water leakage after 30 days following the visit. Brandywine Valley will not be liable for any water damages which may occur from dehumidifiers or other appliances which drain into HVAC equipment drain, or are located in unconditioned space.

Water Disclaimer

Brandywine Valley's Exclusive One-Year Full Labor Warranty

No warranty work shall be rendered for any customer with a past due account. Brandywine Valley Heating & Air Conditioning shall not be liable for any repairs necessitated by fire, flood, or other acts of God, damage by negligence or misuse by others, faulty system design, improper operation, malicious mischief or vandalism. For Flat Rate Customers, all residential service work is fully warranted for a period of one year. Commercial work is fully warranted for a period of one year. Brandywine Valley Heating & Air Conditioning makes no other warranties, expressed or implied, and its agents or technicians are not authorized to make any such warranties on behalf of Brandywine Valley & Air Conditioning.
